Terms of Service
Please read these terms carefully before renting a vehicle with CarPalma in Palma de Mallorca.
1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "Driver", or "you") and CarPalma ("we", "us", or "our"), a vehicle rental service operating in Palma de Mallorca, Balearic Islands, Spain. By accessing our website at carpalma.com, completing an online reservation, or collecting a rental vehicle, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.
These Terms apply to all vehicle rentals arranged through our platform, whether the booking is made directly via carpalma.com, by telephone, or in person at our Palma de Mallorca service point. If you do not agree with any part of these Terms, you must not proceed with a booking or collect a vehicle.
We reserve the right to amend these Terms at any time. The version published on our website at the time of your booking will govern your rental agreement. We encourage you to review these Terms prior to each new reservation.
2. Eligibility Requirements for Car Rental in Palma de Mallorca
To rent a vehicle through CarPalma, you must meet the following requirements at the time of collection:
- You must be at least 21 years of age at the time of rental. Drivers between the ages of 21 and 24 ("young drivers") may be subject to a young driver supplement, which will be disclosed clearly during the booking process.
- For premium, luxury, or high-category vehicles, the minimum age requirement is 25 years.
- You must hold a valid, full driving licence that has been held for a minimum of 12 months prior to the rental start date.
- EU and EEA licence holders do not require an International Driving Permit. Drivers holding licences issued outside the EU - including those from the United Kingdom, United States, Canada, and Australia - may use their national licence for short-stay rentals in Spain. Licences not printed in Latin script must be accompanied by a certified International Driving Permit.
- All drivers must be present at vehicle collection and must provide their original driving licence. Digital or photocopied licences are not accepted.
- Additional drivers must also be present at collection, hold a qualifying licence, and meet the same age requirements. An additional driver fee may apply and will be disclosed prior to booking.
CarPalma reserves the right to refuse vehicle handover where a driver cannot present valid identification and a satisfactory driving licence at the collection point in Palma de Mallorca.
3. Bookings, Reservations, and Cancellation Policy
Reservations made through carpalma.com are confirmed upon receipt of a booking confirmation email. Your booking secures the vehicle category selected; specific vehicle models are subject to availability at the time of collection.
Our no-deposit booking model means that in most cases no payment or security hold is taken at the time of reservation. This low-commitment approach is one of the core advantages of renting with CarPalma. Where a prepayment is required for certain promotions or long-term rentals, this will be clearly communicated prior to completing your booking.
Free Cancellation
Most bookings on carpalma.com are eligible for free cancellation up to 48 hours before the scheduled collection time. Cancellations made within 48 hours of the reservation start time may incur a cancellation fee equivalent to one day's rental rate at the applicable tariff. Cancellation terms for any specific booking will be confirmed at the time of reservation.
No-Show Policy
If you fail to collect your vehicle within two hours of the agreed pickup time at Palma de Mallorca Airport (PMI) or any other agreed collection point, and have not notified us in advance, the booking may be treated as a no-show. In such cases, the full value of the rental or a defined no-show fee may be charged. We strongly recommend contacting us as early as possible if your travel plans change.
Amendments
Booking amendments, including changes to pickup date, return date, or collection location, are subject to availability and may result in a revised rental rate. Amendments requested within 24 hours of collection cannot always be guaranteed but we will make every effort to accommodate reasonable requests.
4. Pricing, Payment, and Included Services
All prices displayed on carpalma.com are quoted in Euros (EUR) and include Spanish Value Added Tax (IVA) at the applicable rate. The total rental price shown at the time of booking confirmation is the price you will pay, subject to any optional extras or amendments made thereafter.
What Is Included as Standard
- Third-party liability insurance as required under Spanish and EU law
- Collision Damage Waiver (CDW) reducing financial liability in the event of an accident or damage to the vehicle
- Theft Protection (TP) covering the vehicle in the event of verified theft
- Unlimited mileage on all standard rental categories
- Airport and port collection service where applicable
- 24-hour roadside assistance within the Balearic Islands
Optional Extras
The following optional extras may be added to your booking at the rates displayed during the reservation process:
- GPS satellite navigation system
- Baby seat, infant carrier, or booster seat for child passengers
- Additional authorised driver
- Portable Wi-Fi hotspot
- Super Collision Damage Waiver (SCDW) - full coverage upgrade to reduce or eliminate the excess amount
Fuel Policy
Unless otherwise stated in your booking confirmation, our standard fuel policy is full-to-full. You will collect the vehicle with a full tank of fuel and are required to return it with a full tank. Failure to return the vehicle with a full tank will result in a fuel charge based on the missing quantity plus a refuelling service fee. Pre-purchase fuel options are available at checkout where offered.
Payment Methods
CarPalma accepts debit cards, credit cards, and major digital payment methods. Our no-credit-card booking policy means that a debit card is fully sufficient for the majority of bookings. Specific payment method requirements for individual rental categories will be disclosed at the time of reservation.
5. Vehicle Use Rules and Prohibited Activities
Rental vehicles may only be used in accordance with applicable Spanish law and the terms set out in this agreement. By collecting the vehicle, you agree to use it exclusively for lawful, personal, or business travel purposes within permitted geographic boundaries.
Permitted Use
Vehicles are authorised for use on paved public roads throughout Mallorca and, unless otherwise agreed in writing, within mainland Spain and other EU member states where cross-border travel has been pre-authorised.
Prohibited Activities
The following uses are strictly prohibited and will result in immediate termination of the rental agreement and potential liability for damages:
- Driving on unsurfaced, unmaintained, or off-road terrain. This includes mountain tracks, agricultural paths, and unsealed routes in areas such as the Serra de Tramuntana or the rural southeast of Mallorca.
- Use of the vehicle for motor racing, rallying, timed driving events, or any form of competitive driving.
- Subletting, hiring out, or otherwise allowing unauthorised third parties to use the vehicle.
- Operating the vehicle under the influence of alcohol, drugs, or any substance that impairs driving ability, as defined by Spanish traffic law (Ley de Trafico, Circulacion de Vehiculos a Motor y Seguridad Vial).
- Using the vehicle to transport goods or passengers for commercial gain or as a taxi or ride-share vehicle.
- Transporting hazardous, illegal, or controlled substances.
- Driving outside the agreed geographic territory without prior written authorisation from CarPalma.
- Allowing a driver not named in the rental agreement to operate the vehicle.
- Towing, pushing, or pulling another vehicle without written authorisation.
Any breach of these vehicle use terms will void applicable insurance coverage and may result in the customer bearing full financial responsibility for any resulting damage, theft, or third-party claims.
6. Insurance, Liability, and Excess Amounts
All CarPalma rental vehicles include mandatory third-party liability insurance as required under Spanish law and EU Directive 2009/103/EC relating to motor insurance. The following coverage is included as standard with every booking:
Standard Coverage Included
- Third-Party Liability (TPL): Covers bodily injury and property damage caused to third parties in the event of an accident where the driver is at fault. Coverage limits comply with current Spanish minimum requirements.
- Collision Damage Waiver (CDW): Reduces your financial liability for damage to the rental vehicle itself. An excess amount applies, meaning you remain responsible for a defined amount per incident. The applicable excess will be confirmed in your booking documentation.
- Theft Protection (TP): Reduces your liability in the event of the vehicle being stolen. An excess applies on the same basis as CDW.
Optional Full Coverage Upgrade
Customers may purchase a Super CDW (SCDW) upgrade, which reduces or eliminates the excess amount for damage and theft claims. This optional coverage is available at checkout and is recommended for customers who prefer complete peace of mind during their stay in Palma de Mallorca and across the island.
Coverage Exclusions
Standard and upgraded insurance coverage does not apply in the following circumstances:
- Damage resulting from prohibited vehicle use as described in Section 5 above
- Damage to tyres, wheels, undercarriage, roof, interior, or glass where caused by negligent or reckless driving
- Damage or loss resulting from driving under the influence of alcohol or controlled substances
- Theft where vehicle keys were left in the vehicle or reasonable security precautions were not taken
- Damage resulting from unauthorised use by a driver not named in the rental agreement
In the event of an accident, damage, or theft, you are required to notify CarPalma immediately and, where applicable, to contact the Policia Local de Palma or the Guardia Civil to obtain an official incident report. Failure to report incidents promptly may affect your coverage.
7. Limitation of Liability
CarPalma operates as a vehicle rental provider. To the maximum extent permitted by Spanish and EU applicable law, our total liability to you in connection with any single rental agreement shall not exceed the total amount paid by you for that rental.
We are not liable for any indirect, consequential, or incidental losses arising from the use or inability to use a rental vehicle, including but not limited to: loss of enjoyment, missed travel connections, delayed flights to or from Palma de Mallorca Airport, or losses arising from traffic conditions on roads such as the Ma-19 motorway or the Paseo Maritimo.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our proven negligence, or for any matter where limitation of liability is not permitted by law.
We make no warranties regarding the availability of specific vehicle models. Vehicle availability is subject to operational factors and we reserve the right to substitute an equivalent or upgraded vehicle category where the booked category is unavailable.
8. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising in connection with these Terms or a rental agreement shall be subject to the exclusive jurisdiction of the courts of Palma de Mallorca, Balearic Islands, Spain, unless mandatory consumer protection provisions in your country of residence require otherwise.
Customers who are residents of an EU member state may also refer unresolved disputes to the EU Online Dispute Resolution platform in accordance with Regulation (EU) No 524/2013.
We are committed to resolving disputes fairly and efficiently. If you have a complaint, we encourage you to contact our team directly in the first instance so that we can work toward a satisfactory resolution before any formal proceedings are initiated.
